The determination of residency is made at the level of the postsecondary school (i.e. it is a university). There is no recourse to this decision before a higher government agency.
The most important areas that staff from universities review to determine the residency of a student include the following, but aren’t only limited to, the following:
- Is the student dependent or an independent student?
Independent or dependent status will be determined by an original copy of the student’s, his/her parent’s, or legal guardian’s latest tax return or other documents depending on the need. - Does this child (or their parent, legal guardianship or parents, if you are a dependent) established legal connections to Florida?
The university personnel who review an applicant’s application for residency requirements will require a variety of kinds of documents to prove legal ties and timeframes. The student and their parent or legal guardian might be required to submit copies of drivers licenses, State of Florida Identification Card voter registration and proof of purchase for permanent residence as well as permanent Florida work, Florida vehicle registration, or another form of proof.
NOTE: Any student who has decided to permanently move to Florida is required to submit official documents (driver’s license or voter registration.) to determine the starting point for the 12-month residency requirement. - Does your student (or the parent or legal guardian of the student in the event that the student is deemed dependent) had the physical presence of Florida for at minimum 12 (12) months immediately prior to the date of the initial day of enrollment in the period for which Florida residency is required?
- The purpose of living within Florida for the mandatory minimum period of 12 months, be for the purpose of keeping a legitimate residence, rather than to be enrolled in a school of higher education?
Students who come to Florida to complete a full-time course at a state institution as an out-of state resident and who continues to enroll in the state institution does not usually fulfill those Florida residence requirements to be eligible for tuition in-state, regardless of the amount of time that they’re enrolled. - Do you know if the student is seeking reclassification?
students who are classified as dependent student for tuition purposes can apply to be classified as an independent student if they meet the requirements. A burden of proof lies on the student who is seeking the reclassification to prove: (1) residency in Florida for the required 12 months; (2) residency in the state was not for a short period or in connection with enrolment at an institution located in Florida and (3) confirmation as an independent student in the event that they are currently classed as a dependent with parents or legal guardians who reside outside of state.Evidence that can help in proving residency purposes of maintaining a legal home could be an employment contract with a full-time duration (minimum that is 30 hours per week) and immediate relatives living in Florida for the past twelve months, purchase of property, or a full-time enrollment in an Florida university within the last twelve months. One piece of evidence can be taken as to be conclusive.
